Budyko Research Institute, Inc.

Waiver, Release of Liability, and Medical Authorization

By participating in any activity, fieldwork, tour, research, or event organized by Budyko Research Institute, Inc. (BUDYDKO), you agree to the following terms:

1. Assumption of Risk

Participation in Budyko activities may involve inherent risks, including but not limited to:

• Physical exertion

• Environmental exposure (e.g., heat, terrain, wildlife)

• Travel-related risks

By participating, you acknowledge and voluntarily accept all such risks.

2. Release of Liability

You agree to release, waive, and hold harmless Budyko Research Institute, Inc., its directors, employees, contractors, collaborators, and affiliates from any and all claims, liabilities, damages, or expenses arising from:

• Personal injury or illness (including death)

• Property loss or damage

• Participation in any Budyko activity

• Travel to and from activities

This applies to the fullest extent permitted by law.

3. Indemnification

You agree to indemnify and hold harmless Budyko from any claims resulting from:

• Your actions during participation

• Harm caused to yourself, others, or property

4. No Insurance Coverage

Budyko does not provide insurance coverage for participants.You are responsible for maintaining your own:

• Health insurance

• Travel insurance (if applicable)

5. Medical Authorization

In the event of an emergency:

• You authorize Budyko to obtain necessary medical treatment on your behalf in the event of an emergency.

• You agree to be fully responsible for any medical costs incurred.

6. Fitness to Participate

You confirm that:

• You are physically and medically fit to participate

• You have no conditions that would prevent safe participation

7. Binding Agreement

This agreement is binding upon:

• You

• Your heirs, legal representatives, and assigns

8. Voluntary Participation

Your participation is entirely voluntary.By proceeding, you confirm that:

• You have read and understood this agreement

• You accept its terms freely and without coercion

9. Governing Law

This agreement shall be governed by the laws of the State of Texas.

10. Photo and Video Consent

By participating in Budyko activities, you grant Budyko Research Institute, Inc. permission to photograph, record, and capture your image, likeness, voice, and participation through video, audio, or other media.

You authorize Budyko to use, reproduce, edit, and distribute these materials for purposes including, but not limited to:

• Educational and scientific content

• Research dissemination and outreach

• Promotional and marketing materials

• Social media, websites, publications, and digital platforms

You acknowledge and agree that:

• You will not receive compensation for the use of such media

• Budyko retains full rights to use these materials in perpetuity and across all current and future formats

• Your name or identifying information will not be used without additional consent, unless voluntarily provided by you

If you prefer not to be photographed or recorded, you must notify Budyko in writing prior to participation. Budyko will make reasonable efforts to accommodate such requests but cannot guarantee complete exclusion from all media.

Acknowledgment

By participating in Budyko activities, you acknowledge that you have read, understood, and agreed to this waiver.

By registering for the Nuclear Field Trip (“Program”), I acknowledge, understand, and agree to the following:

Assumption of Risk

I understand that participation in this Program involves inherent risks, including but not limited to:

Walking on uneven terrain, steep paths, or historic sites

Exposure to outdoor environmental conditions, including heat, cold, wind, or precipitation

Travel in group vehicles

Visiting underground or historical mining locations

Exposure to museum or laboratory environments

The possibility of slips, falls, fatigue, or other physical injuries

I voluntarily assume all such risks.

Medical Responsibility

I certify that I am physically able to participate in the Program and will disclose any relevant medical conditions. I am responsible for my own medications, personal health needs, and medical expenses.

Release of Liability

I release and hold harmless Budyko Research Institute, its employees, contractors, affiliates, trip leaders, and partners from any liability for injuries, illnesses, accidents, property loss, travel delays, or other incidents that may occur during the Program.

Conduct & Compliance

I agree to follow all safety instructions provided by Program staff. Failure to comply may result in removal from the Program without refund.

Weather & Conditions

I understand that weather conditions may affect the itinerary. I accept that changes may occur for safety reasons.

Refund & Transfer Policy

I understand that:

All registrations are final.

No refunds, cancellations, credits, or transfers are permitted for any reason.

Seats are non-transferable and assigned to me only.

If Budyko Research Institute cancels the Program for safety or unforeseen reasons, I will receive a full refund of the Program fee. I understand that Budyko is not responsible for airfare, travel insurance, or personal travel expenses.

Travel Insurance

I understand that Budyko strongly recommends purchasing travel insurance to protect against flight disruptions or cancellations.

Consent

By checking the box below and submitting payment, I acknowledge that I have read, understand, and agree to this Liability Waiver, the Refund Policy, and all Program Terms & Conditions.

Refund & Transfer Policy

All registrations for this program are final. Refunds and cancellations are not permitted.

Participant transfers may be permitted if requested at least 14 days prior to the program start date.

If Budyko Research Institute cancels the program due to weather, safety concerns, or other unforeseen circumstances, participants will receive a full refund of the program fee. Budyko Research Institute is not responsible for airfare, lodging booked independently, travel delays, or other personal expenses.

Participants are strongly encouraged to purchase travel insurance to protect against flight changes, cancellations, illness, or other travel-related disruptions.
